Definition of an Overweight Vehicle
The City of Surrey defines an overweight vehicle as a vehicle whose licensed gross vehicle weight (G.V.W.) exceeds 5,000 kilograms (11,023 lbs.).
Zoning
The Surrey Zoning By-law, No. 12000 , Part 4, General Provisions states that overweight vehicles are not permitted to be parked or stored either inside or outside a building or structure on any lot in a residential zone.
A recent court decision has deemed that residential properties that have had vehicles parked on them prior to May 23, 1989, and have continued to park on that same residential property, have a “non-conforming use” and may be able to remain parked on the residential property. A By-law Enforcement Officer determines whether an individual property has a non-conforming use.
Certain industrial zoning allows for the parking of overweight vehicles: IL (Light Impact Industrial), IH (High Impact Industrial) and IS (Salvage Industrial). Also, overweight vehicles may be parked in agricultural zones if the parking of the truck is related to the agricultural use of the property.
Overweight Vehicle Parking on City Streets
The Highway and Traffic By-law, No. 13007 , regulates the parking of overweight vehicles on the City streets. Overweight vehicles are not permitted to park in a residential district at any time except for the delivery or pick up of chattels. Overweight vehicles are not permitted to park on any street within the City limits between the hours of 7:00 pm and 7:00 am.
